The terms that govern all services provided by Psyche Creative (trading name of Adam Watters Creative).

About these terms

These terms apply to all services provided by Adam Watters Creative (trading as Psyche Creative), a sole trader registered in the United Kingdom. By engaging our services — whether verbally, via email or through a signed proposal — you agree to these terms.

Our services

We provide marketing services including web design, social media management, video production, advertising, graphic design, and full-funnel campaigns. The exact scope of each engagement is set out in a written proposal or statement of work, agreed before work begins.

Payment

Payment terms are set out in each project proposal. Standard terms are:

  • Fixed-price projects: 50% deposit on commencement, 50% on delivery
  • Retainer work: monthly in advance
  • Ad spend: invoiced separately; client retains control of ad accounts

Late payments may incur interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.

Intellectual property

All deliverables become your property on receipt of full payment. We retain the right to reference the project in our portfolio and case studies unless otherwise agreed in writing.

Third-party assets (stock images, fonts, plugins, licenced software) are licenced separately. Any licence terms pass to you on project completion, and it is your responsibility to maintain any ongoing subscription licences required.

Confidentiality

We treat all client information as confidential. We will not share information about your practice, clients, or business with third parties without your consent, except where required by law. This includes information about the therapeutic work you do — we understand the sensitivity of that context.

Limitation of liability

Our total liability for any claim arising from our services is limited to the value of the fees paid for the specific project or month in question. We are not liable for any indirect, consequential, or speculative losses including loss of revenue, clients or data.

We do not guarantee specific outcomes from marketing work (search rankings, engagement levels, conversion rates) as these depend on many factors outside our control.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
